OPERATION OF CHAPTER 2 ILYUSHIN 76 AIRCRAFT TO THE UK

Thank you for your email providing further information in support of your
request to operate a Chapter 2 aircraft into the UK.
We note that you say that no other aircraft could be used to operate this
flight due to the volume of the cargo to be carried. However we remain
convinced that a noise compliant aircraft, eg Antonov 124, could carry this consignment and that such an aircraft could be chartered for this operation.
As we explained Regulation 25 states that the CAA shall not grant an
exemption unless the operations of the aeroplane are of such an exceptional nature that it would be unreasonable to withhold such an exemption, or the aeroplane is being operated on a non-revenue flight for the purposes of alterations, repair or maintenance. The CAA considers operations of an exceptional nature to comprise, for example, urgent humanitarian relief flights or official visits by Heads of State.
You will see from the above therefore that we are under considerable
constraint when assessing applications for exemptions for non noise
compliant aircraft and we are able to grant only in narrowly defined
circumstances. We must be convinced in each case that a Chapter 3 aircraft is not available even at greater expense.

Based on the information supplied in your letter, we do not believe that the proposed operation meets the test of being of an "exceptional nature" as required by the Regulations.
